Applying for Disability Benefits
Available to California employees is a program paid for by employees and administered by EDD usually called State Disability. You need a doctor’s certificate that you cannot do your regular work due to any medical condition. You can apply on-line at EDD.gov. Benefits are payable for up to a year, depending on your earning history. If your medical condition is due to your work, you should investigate filing a Worker’s Compensation claim with Gold Country Workers’ Comp Center. EDD deducts whatever payments you are receiving from a Workers’ Comp claim before paying you any balance.
Additionally, most Americans are eligible to apply for disability benefits offered by the Social Security Administration. There are two types of benefits under this program, Social Security Disability Insurance benefits (SSDI) as well as the Supplemental Security Income program (SSI). Most people are entitled to SSDI if they made enough earnings and accumulated enough work credits, but if that’s not the case, people under a certain income and resource bracket will qualify for SSI. The medical showing that must be made is the same for both of these programs.
Applying for disability benefits is often pretty self-explanatory and straight forward (although tedious) process, but once the application is filed and being processed, then comes the hard part. Every claim requires enough medical evidence to support it. Adequate information has to prove you are unable to work your current job for at least twelve months AND that you medically can’t really work at ANY job. A disability attorney can determine if you won’t be able to return to work due to your medical conditions, physical or mental or in combination. The good thing is that although you have to prove you will be out of work 12 months, you can apply as soon as you have stopped working.
